TERMS OF USE

Please read these Terms of Use ("Terms", "Agreement") carefully before deploying, installing, or operating WifiSocks Router OS software packages or digital licenses ("Software", "Product") provided by WifiSocks ("Company", "We", "Us"). Installing, activating, or using the Software constitutes your full and unconditional agreement to these Terms. If you do not agree with any provision herein, do not install or use the Software.

1. Nature of Product, Digital Software License & Hardware Disclaimer

1.1. 100% Software-Only Model: WifiSocks Router OS is an independent software solution and OpenWrt package (.ipk) engineered for centralized proxy routing, policy-based traffic dispatching, and gateway-level leak protection. The Company is solely a software development entity and does NOT manufacture, assemble, import, or distribute physical hardware routers.

1.2. Bring Your Own Device (BYOD): The Software is provided strictly as a Digital Software License. Users are solely and independently responsible for sourcing, owning, and maintaining compatible OpenWrt-supported hardware (Mini PCs, Wi-Fi 6 routers, or virtual machines).

1.3. Telecommunications Compliance: Users are solely responsible for ensuring that their hardware devices have obtained all requisite regulatory certifications and approvals (such as QCVN, FCC, CE) in their respective national jurisdictions prior to installing or operating the Software.

2. Bring Your Own Network (BYON), Neutral Tool & Open Cryptography

2.1. Neutral Network Tool: WifiSocks operates strictly as a neutral Layer 3 / Layer 4 traffic dispatching and policy routing tool. The Company does not provide, sell, host, or broker external proxy lines, VPN servers, or digital identity credentials.

2.2. User-Supplied Network Routing: Users must provide their own external proxies or upstream tunnels. The Company does not monitor, inspect, store, or log user traffic, payload contents, or browsing history routed through the local gateway.

2.3. Standard Open Cryptography (BYO-Crypto): The Software acts as a packet dispatcher and utilizes standard open-source cryptographic libraries provided by the base OpenWrt/Linux distribution (e.g., OpenSSL). The Software does NOT implement or distribute proprietary concealed encryption algorithms, nor does it provide civil cryptography solutions under specialized licensing mandates. All cryptographic configurations remain under the sole control of the user and their external network providers.

3. Flashing & Installation Waiver (AS-IS Principle)
DISCLAIMER OF INSTALLATION RISKS (AS-IS & BRICKING WAIVER):
THE SOFTWARE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. FLASHING FIRMWARE OR INSTALLING PACKAGES ONTO ROUTER HARDWARE IS A TECHNICAL PROCEDURE THAT INVOLVES INHERENT RISKS TO BOOTLOADER INTEGRITY, MEMORY STORAGE, AND PHYSICAL CIRCUITRY. WIFISOCKS EXPLICITLY DISCLAIMS ANY AND ALL LIABILITY FOR DEVICE BRICKING, HARDWARE MALFUNCTION, POWER LOSS, DATA LOSS, CORRUPTION, OR BUSINESS INTERRUPTION ARISING FROM USER INSTALLATION, FLASHING, OR UPGRADE OPERATIONS.
4. Acceptable Use Policy & Anti-Cybercrime Compliance (AUP)

4.1. Permitted Lawful Uses: The Software is designed strictly for lawful networking applications, including QA and automation testing labs, enterprise multi-workstation isolation, e-commerce operations, and zero-trust IoT network segmentation.

4.2. Strictly Prohibited Activities: Users explicitly agree NOT to deploy or utilize the Software for any illicit or malicious purpose, including but not limited to: fraud, illegal gambling, money laundering, distributed denial-of-service (DDoS) attacks, malware distribution, botnet operations, unauthorized computer access, or any action violating applicable computer crime and cybersecurity laws (including Article 287 of the Vietnam Penal Code and international cybercrime treaties).

4.3. Sole User Responsibility: Users bear exclusive civil and criminal legal liability for all network traffic, external proxy configurations, and actions conducted through their deployment of the Software.

5. License Revocation & Judicial Cooperation (Kill-Switch Policy)

5.1. Right of Revocation: WifiSocks reserves the right to unilaterally revoke, suspend, or terminate any Digital License Key immediately and without prior notice or refund if: (a) The user violates any term of this Agreement; or (b) A formal, lawful request is received from competent law enforcement, cybersecurity agencies, or judicial authorities.

5.2. Legal Cooperation: WifiSocks fully complies with applicable laws and reserves the right to cooperate with judicial investigations in accordance with statutory procedures.

6. Open Source Licensing (GNU GPLv2) & Intellectual Property

6.1. Architectural Segregation: WifiSocks Router OS maintains a strict architectural boundary:

  • Base Operating System (Kernel & OpenWrt Base): Governed by the GNU General Public License version 2 (GPLv2). Respective upstream source code is made publicly available in compliance with GPLv2 requirements.
  • Proprietary Userspace Layer: The WifiSocks routing daemon, Web Management Console, Virtual Gateway Identifier (VGI) modules, and Cloud License Client operate independently in userspace and remain the exclusive proprietary intellectual property of WifiSocks.

6.2. Prohibited Conduct: Reverse engineering, decompiling, cracking, redistributing, or creating unauthorized derivative works of the proprietary userspace software is strictly prohibited.

7. Limitation of Liability Ceiling
IN NO EVENT AND UNDER NO LEGAL THEORY (WHETHER IN CONTRACT, TORT, OR OTHERWISE) SHALL THE TOTAL AGGREGATE LIABILITY OF WIFISOCKS ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE EXCEED THE ACTUAL AMOUNT PAID BY THE USER FOR THE SPECIFIC DIGITAL SOFTWARE LICENSE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
8. Governing Law & Dispute Resolution

8.1. These Terms shall be governed by and construed in accordance with applicable governing statutory laws.

8.2. Any dispute arising out of or in connection with these Terms shall first be addressed through good-faith technical negotiation. If unresolved, disputes shall be submitted to the competent jurisdiction.
